To ask that a print version of Enrollee Rights and Responsibilities be mailed to you, call the Customer Service number on your Medica ID card.
The laws of Minnesota give you legal rights; these include the right to:
- Be treated with respect, dignity, and consideration for privacy
- Have access to medical care. This includes emergency care 24 hours a day, 7 days a week.
- Information about your health, your treatment options and risks so you can make an informed choice about your health care.
- Refuse treatment that Medica or any providers recommend to you. Get information about what might happen if you refuse treatment.
- Privacy of your medical and financial records kept by Medica or any Medica provider. This will be done according to current law.
- Request and receive a copy of your medical records. You also have the right to ask to correct the records.
- File a grievance with Medica or the Minnesota Department of Health. You may begin a legal proceeding if you have a problem with Medica or any provider. For information, contact the Minnesota Department of Health at 651-282-5600 or toll free at 1-800-657-3916. Ask for HMO information. - File an appeal with Medica or request a State fair hearing with the Minnesota Department of Human Services (also referred to as "the State"). You may request a State fair hearing before or at any time during Medica’s grievance or appeal process. You do not have to file a grievance or appeal with Medica before you request a State fair hearing. - A clear explanation of covered nursing home and home care services.
- Give written instructions about your medical care. This is called a "health care directive".
- Choose where you will get family planning services.
- Get a second opinion for medical, mental health, and chemical dependency services.
- Be free of restraints or seclusion used as a means of: coercion; discipline; convenience; or retaliation during your health care visits.
- Request a copy of your Certificate of Coverage at any time.
- Exercise your rights and that the exercise of your rights will not adversely affect the way you are treated.
Medica has identified some additional rights, including the right to:
- Receive information about Medica, its services and providers, and enrollees’ rights and responsibilities.
- Join with health care providers in decision making regarding your health care.
- Full discussion of ways you can be treated medically.
- Make suggestions on how to improve Medica’s members’ rights and responsibilities statement.
Medica believes that enrollees should take an active role in their health care and in seeking proper health care. This is a listing of your responsibilities for staying healthy and getting the right health care:
- Establish a relationship with a Medica Choice Care doctor before you become ill. This helps you and your doctor, understand your total health condition.
- Join in discussion with your health care provider in deciding your health care options.
- Give all the information asked for by your doctor. Share information about your lifestyle and your personal and family history.
- Follow all instructions given by your doctor. If you have questions about your care, ask your doctor.
- Practice self-care by knowing how to spot common health problems. You should also know what to do when a health problem occurs, when and where to seek help, and how to prevent health problems.
- Practice preventive health care. Have tests, exams, and shots recommended for you based on your gender and age.
- Live a healthy lifestyle that includes exercise, eating well-balanced meals, getting rest and not smoking.
